1. Top Notch Dezigns NY, LLC starts working on a project upon receipt of a down payment. Top Notch Dezigns NY, LLC requires 50% of the total amount due before starting work on a custom web site design. The remaining balance must be paid upon completion of the project or 60 days after beginning the project, whichever comes first, regardless of project status. If 60 days has passed, the remaining balance is due regardless of project status. Does not apply for graphic design, and photo video montage these services we require payment in full. All payments should be paid to “Top Notch Dezigns NY, LLC.”
2. Additional services come at additional fees, based on our hourly rates.
3. All content and images for the web site is to be provided by the Client.
4. Top Notch Dezigns NY, LLC will only use materials that are in accordance with copyright laws and the Client will not provide material to Top Notch Dezigns NY, LLC for use in a web site design that violates such laws.
5. After final approval and final payment have been received by the Client Top Notch Dezigns NY, LLC will launch website. Changes to the design after approval has been given by the client Top Notch Dezigns NY, LLC will bill the client at an hourly rate for any modifications.
6. If a payment is not processed on time, a late fee of $15 per day is added to the bill and the project can be put on hold or canceled at Top Notch Dezigns NY, LLC's whole discretion. If the project is not canceled, it is Top Notch Dezigns NY, LLC's whole discretion to decide when to resume work on the project once the late payment and the late fees are processed.
7. Delays in project completion may occur when:
   • There is a delay in any payments
   • The client requests further work, including changes in the scope, design, structure, or content of the project
   • The client purchases an additional service related to the project
   • There is a delay in the receipt of any materials from the client
8. Time frame estimates are approximate only and are subject to change at any time at Top Notch Dezigns NY, LLC's discretion
9. Top Notch Dezigns NY, LLC will under no circumstances be held responsible to satisfy unreasonable expectations or requests that lie beyond the scope of Top Notch Dezigns NY, LLC's offer of services to its client. It is Top Notch Dezigns NY, LLC's discretion to decide whether or not a request or an expectation is reasonable or lies within the scope of offer of services to its client. In other words, Top Notch Dezigns NY, LLC will make all the necessary efforts to satisfy the client within the framework of its original agreement with the client, according to Top Notch Dezigns NY, LLC's understanding.
10. It is important to understand that we cannot make our project resources available to a project indefinitely as we have other obligations. If a project stalls or a client becomes unresponsive for more than 3 weeks, the project will become "inactive" and a reengagement fee of 15% of the total project cost will be assessed upon reinitiating the project. If there is no meaningful activity for 3 months the project may be terminated without refund.
11. All payments are final. It is Top Notch Dezigns NY, LLC's policy that no refunds will be made.
12. Please keep in mind that for security reasons, Top Notch Dezigns NY, LLC: Utilizes PayPal as a third party payment center to process checks, credit cards, and debits cards to ensure that no information in stored in our database. Any concerns in regards to security measurements please contact or visit Paypal.

2. Because of the nature of web design and programming work, websites always appear differently on different computers. Screen resolution, operating system, and browsing software are just a few examples of variables that may affect the way a website looks. The client must be aware of these possible variations and Top Notch Dezigns NY, LLC will not be held responsible for them.
3. A small sign stating "Website Design by Top Notch Dezigns NY, LLC" will be added at the bottom of every web page created (programmed or designed) by Top Notch Dezigns NY, LLC. The client may request to remove the sign for an additional fee of 20% of the total price of the services provided to the client in relation to the web page.
4. We do not provide administration or backend information when we construct a website (excludes FTP login information and database) to our clients. We do offer a sign off release for $799 for any client who will like such information.
5. Top Notch Dezigns NY, LLC may, at his sole discretion, choose to showcase on its website projects the Top Notch Dezigns NY, LLC team has worked on, or is working on, including screenshots, a link to the live website, a summary of Top Notch Dezigns NY, LLC role in regards to the project, etc. The client must understand and agree that we are in no way committed to displaying, or linking to, their website(s) or online project(s) on our website, but that we may choose to do so, at our sole discretion.
7. Top Notch Dezigns NY, LLC may offer 3 months, one year, two years, or three years free web hosting and domain name registration to its clients depending on the website package. The period is calculated from the date the project start and not when the project is completed. 

Graphic and Flash Design

1. Top Notch Dezigns NY, LLC does not provide master copies for example: PSD, AI, FLA, etc to our client. If client wishes to have the master copies they can sign a release form for $200 to retrieve each master copy.
